Official Contest Rules

HOW IT WORKS: From January 1, 2008 through December 31, 2010, GST, Inc. (“GST”) individuals (“Customer” or “Customers”) visiting the GST web site may enter our GST Giveaway Contest (“Contest”). Each Customer is limited to one entry per month and twelve entries per year. Expect for the Contest winners (“Winner”), entries are rolled forward to the subsequent month.

ELIGIBILITY: NO PURCHASE IS NECESSARY TO ENTER OR WIN. THE CONTEST IS OPEN ONLY TO CUSTOMERS LOGGING ONTO THE INTERNET, AGE 18 OR OLDER. Employees and other representatives of GST, their affiliates, and advisors (and the immediate family of each) are not eligible to win. All applicable federal, state, and local laws and regulations apply. Offer void where prohibited. GST can accept only those entries that are completed and submitted in the formats designated. Entries must contain accurate, current, and fully complete information including either a valid email address or phone number. If you cannot be reached by return email, or a phone number, your entry will be null and void. GST will not be responsible or liable for: (a) any failure to receive entries owing to transmission failures and other conditions beyond its reasonable control or (b) any printing or typographical errors in any materials associated with the contest.

AGREEMENT TO OFFICIAL RULES: By participating in the contest, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of GST, which are final and binding.

TO CLAIM CONTEST: Winners will be notified by email or phone by the seventh day (7th) of each month, at the email address or phone number provided by entrant on the contest entry email and winners will have 30 days from the date of notification to claim the Contest. Contests not claimed within 30 days will be forfeited. No substitution or transfer of Contests will be permitted. Unclaimed Contests will not be awarded. Winners may be required to complete and sign an affidavit of eligibility. U.S. federal, state and local taxes on Contests are the sole responsibility of the winner.

AVAILABLE CONTESTS/OFFERS: ODDS OF WINNING ARE BASED ON TOTAL NUMBER OF ENTRIES SUBMITTED.

GENERAL RULES: All federal laws and regulations apply. Verification of winners is under the supervision of GST, whose decision is final. Acceptance of Contest constitutes permission to GST and its agencies to use winner's name and/or likeness for purposes of advertising and promotion without further compensation, unless prohibited by law. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of GST with respect to all contest related matters. GENERAL CONDITIONS: GST reserves the right to cancel or modify the contest if fraud, technical failures or any other factor beyond GST's reasonable control impairs the integrity of the contest, as determined by GST in its sole discretion. In such event, GST reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the contest is a violation of criminal and civil law, and, should such an attempt be made, GST reserves the right to seek damages from any such person to the fullest extent permitted by law. GST's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

HARDWARE UTILIZATION: GST reserves the right to utilize either Bull Escala or IBM p5 hardware. GST ensures 100% compatibility between both manufacturers.

RELEASE: By entering this contest, entrant agrees to release and hold harmless, GST, its related companies, and its respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the contest or receipt or use of any Contest.

LIMITATIONS OF LIABILITY: GST is not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the contest; (iv) electronic or human error which may occur in the administration of the contest or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the contest.
8. DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this contest, or any Contests awarded, other than the administration of the contest or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Los Angeles; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and GST in connection with the contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
